QUANTUM CONSULTING.AI LLC, trading as Quantum Consulting AI. Last updated September 14, 2026
These Terms of Service ("Terms") are a contract between you and QUANTUM CONSULTING.AI LLC, a Florida limited liability company at 382 NE 191st St PMB 346859, Miami, Florida 33179-3899. We trade as Quantum Consulting AI. That is the name you see on our pages and in our messages. Your receipt and order emails show it as QUANTUM CONSULTING AI, LLC. Each of these is the same company. In these Terms, "Quantum", "we" and "us" mean QUANTUM CONSULTING.AI LLC.
These Terms govern every order you place with us, whether through our websites, including quantumconsultingsolutions.io and quantumconsulting.ai, through a payment page linked from them or sent to you by us, by replying to one of our messages to order a service, or by accepting a written proposal for a service sold on application. They also govern any account or data console we give you access to.
How you accept. You accept these Terms and our Privacy Policy when you click Place Order on a checkout page, the Yes button on a subscription page, an order button on the activation page (such as Get it built and handed over, Get it built and managed, Get paid ads managed or Lock my territory), or any other button that places an order with us, and when you accept a written proposal for a service sold on application. You also accept them by using a delivery, an account or a data console we provide. Each order is governed by the version of these Terms in effect on the day you place it. Section 26 says when a change takes effect and how it reaches a subscription or monthly service you already hold. If you do not accept these Terms, do not place an order and do not use a delivery.
Business use only. We sell to businesses and business owners for business use. By ordering you confirm that you are buying for a business, and not as a consumer for personal, family or household purposes. If you order for a company, you confirm that you have authority to bind it, and "you" in these Terms means that company.
If a page and these Terms say different things. Your order page supplies three things for your order: the name of the service you buy, its price and the delivery timing. What each service contains, and the conditions on it, are set out in these Terms. On everything else, if a page and these Terms conflict, these Terms control. Section 28 says this in full.
"No contract" on our pages. Our pages say "No contract". On the Reveal pages it means the Reveal is a one time purchase: nothing renews and you are not signed up to a subscription. On the subscription pages it means the subscriptions have no minimum term and run month to month (section 8). It does not mean there is no agreement. These Terms still govern every order.
We find people who are actively in the market for what you sell and, where your website carries real traffic, we put names to as many of the people who visit your website as our data sources can identify. We deliver their contact information and related attributes to you. Much of this is personal information about individuals who have no relationship with us or with you.
What a record contains. For a consumer audience, a record can include a person's name, home postal address, personal and business email addresses, mobile and landline numbers, age range, home ownership, income band, household attributes, and signals about what the person has been researching. For a business audience, a record can include name, job title, company, business email, business phone, company size and industry. A record of an identified visitor to your website, whatever audience you sell to, can include any of these fields. Both kinds of record can also carry hashed versions of the email addresses and phone numbers that advertising platforms accept for audience matching, together with a do not call flag and an email validation marker (section 13). Records never contain government identification numbers, financial account numbers or medical records. Income is delivered as an estimated range, not as account or transaction data. A research signal can show interest in a health related service, such as dental or cosmetic treatment, where that is the category you sell in. We do not build or deliver audiences based on health conditions, treatments or research into health care services for residents of Washington or Nevada.
Why this matters to you. Because every record describes an individual, including a business record, which names a person at a company, consumer protection and privacy laws apply to how you contact them. Sections 11 to 14 set out the rules you agree to when you use the data. They are conditions of your order, not a substitute for the laws that apply to your outreach, which remain your responsibility under section 13.
Our services.
Each is priced on the order page where you buy it or, for a service sold on application, in the written proposal you accept.
Built for you. Every list we build is built for your order from the market you describe in your build form, and the list itself goes only to you. We do not run a lead marketplace, where one lead is sold to several competitors at once. Unless you buy Territory Exclusivity, we may build a list for another business in your category and area, and the underlying records come from sources that other companies also use, so the same person can appear in more than one list.
Your order. The name of the service, the price and the delivery timing shown on the order page at the time you order form part of your order, and your receipt email records the service and the price you paid. Section 28 says how the order page and these Terms fit together.
The Reveal is a one time purchase at the price shown on the order page. It is two things.
(a) Your in market list. A list of people actively in the market for what you sell, in the area you serve, with more than 50 fields on every person, including names, email addresses, phone numbers and mailing addresses. Direct phone numbers are less consistently available on business records, as the guarantee fine print in section 7 says. It is delivered as a spreadsheet or CSV file by email within 24 hours of completing your build form (section 5), unless the market check in section 6 leads you to choose an adjusted build or a refund.
(b) 30 days of Quantum Identity Resolution, if your website carries real traffic. It starts when the tracking is installed and confirmed working, as section 5 describes, and it is delivered as records of identified visitors during that period.
Every record is screened with do not call flags and email validation markers. Section 13 says what those are and what they are not.
Real traffic. Real traffic means genuine visits by people, not bot driven or automated traffic. That is the same condition the 40% Guarantee uses in section 7. The identification part of the Reveal runs on any website with real traffic that meets the conditions in section 15. The 40% Guarantee has its own visitor threshold, 1,000 or more monthly visitors, stated in section 7. The identification part of the Reveal is available for 90 days after your order. If your website does not carry real traffic, or the tracking is not installed and confirmed working within those 90 days, the identification part does not run, and the price of the Reveal does not change, because the in market list does not depend on your website.
Add ons. Verified Contact Enrichment and The Outreach Playbook are optional add ons offered at checkout with a Reveal, priced on the order page. Neither is required. Verified Contact Enrichment adds skip traced mobile numbers and validated email addresses to the records we deliver during your 30 days, with the result marked on each record. It is a verification pass run at the time of build. It does not guarantee that every record will carry a mobile number, and it does not replace the checks section 13 requires you to run. The Outreach Playbook is a set of email, call and text scripts for use in your own business. You may not resell, publish or share it. Using a text script from the Playbook does not create consent to text anyone; the texting rule in section 13 still applies.
To build your Reveal we need one thing from you: your build form. Nothing is built until it is in. Your build form is complete the moment you submit it to us. Your order stays open until then. If your build form is not complete 60 days after your order, we email you a reminder. If it is still not complete 30 days after that reminder, we close the order and refund it in full, because we have done no work for it.
Your list lands within 24 hours of completing your build form. The 24 hours runs from the moment you submit the form. We attach no conditions of our own to that promise. One thing in these Terms can come before delivery: the market check in section 6. If we call you under section 6, we do it inside the same 24 hours, and your list then lands within 24 hours of the moment you tell us in writing to proceed, with the original build or the adjusted one. We may also contact you about your build, for example to settle the search terms your buyers use, and the 24 hours still runs. An onboarding call is optional. Booking one, or not booking one, does not change the 24 hours.
Your list is delivered by email, as a spreadsheet or CSV file, to the email address on your order. We may also make it available to you in a data console.
The 24 hours applies to the in market list. The 30 days of visitor identification runs on its own clock, because it can only start once the tracking is live on your website. For that part, we email you the tracking code and show you where it goes. If you would rather not touch your own website, we install it for you at no extra charge when you ask. The 30 days begin on the day the tracking first records visitors on your website. We confirm that day to you in writing within 2 business days. Every visitor identified from that day on is delivered to you as they arrive during the 30 days, in the same spreadsheet or CSV format as your list, by email to the email address on your order or in the data console. That date is separate from your subscription: if you accepted the Engine or Essentials, your trial and your first charge run from the day you clicked the Yes button, as section 8 says, whether or not your tracking is live, and identification under the Engine or Essentials simply continues from where the Reveal leaves off. If the tracking goes live before your in market list is delivered, that does not end the market check in section 6 and does not make your Reveal final.
We check your market before we deliver. Once you are in, we build your audience and look at the real numbers. If your market is too small to be worth what you paid, we call you and tell you before we send anything. We would rather hand your money back than hand you a list that cannot work.
This is a term of your order, and here is how it works. After you order and before we deliver, we review the market you described in your build form. It applies to a Reveal, to a subscription accepted with it, and to Territory Exclusivity bought for the same market, since each depends on the size of the market you name. It does not apply to cold email infrastructure or paid advertising management, which are work on records you already hold. If your market is too small to be worth what you paid, we call you at the phone number on your order, and email you if we cannot reach you by phone, before we deliver anything, and offer you a choice: an adjusted build that we describe to you in writing, or a full refund of the price you paid for that order, including any add ons bought in the same order.
If you choose the refund, we deliver nothing, we cancel any subscription trial accepted with that order before it bills, and we issue the refund to the payment method you used within 5 business days. Your bank may take longer to show it. If you choose the refund, we also cancel and refund any Territory Exclusivity bought for the same market. If you choose the adjusted build, we build and deliver it as described to you in writing, within 24 hours of the moment you tell us to proceed, and your purchase is final once we deliver your list. If we do not make that call, your purchase is final once we deliver your list. The market check is complete when we deliver your list or when you tell us to proceed.
We may also decline to build an order if your build form, or what you tell us, shows a use that sections 11 to 13 do not allow, an audience we do not build under section 3, or an offer we cannot lawfully support. If we decline before delivery, we refund the order in full.
The 40% Guarantee We will put a name, an email address and a phone number to at least 40% of your website traffic within 30 days. Miss that mark and your next month is on us.
For sites with 1,000 or more monthly visitors. For business audiences we guarantee name, verified business email and company details, since direct phone numbers are less consistently available on business records. The guarantee covers what we control, which is identifying and delivering your buyers.
How it works:
The 40% Guarantee, the market check in section 6 and the delivery promise in section 5 are the only promises we make about results or delivery. We do not guarantee that any contact will respond, book or buy. Results depend on your traffic, your offer and how you work the list, and they are not guaranteed for every website.
What they are. The Engine is a monthly subscription at the rate shown on the order page. It includes ongoing visitor identification through the tracking, a rebuilt in market list each month, a sync of your audience into your CRM or email sender, and a monthly delivery report. Essentials is a monthly subscription at the rate shown on the order page. It includes ongoing visitor identification only, delivered each month as a spreadsheet, with no monthly in market lists, no CRM sync and no reporting. You take one or the other, never both.
No minimum term. Subscriptions are month to month. There is no minimum term and no long term commitment. Where our pages say "no contract", that is what it means: no minimum term. These Terms still govern every order, including every subscription.
The free trial. The Engine and Essentials are offered right after a Reveal purchase with a 30 day free trial. The trial starts on the day you accept the subscription by clicking the Yes button. Clicking saves your payment method; nothing is charged that day. Your first charge is taken on day 31 after that date, at the rate shown when you accepted. Cancel before then and nothing is charged. If a page describes the start of the trial or the date of the first charge differently, this section controls. During the free trial you receive what your Reveal already includes: your in market list and, where your website carries real traffic, identification. The Engine's monthly deliverables, the rebuilt list, the sync and the report, begin with your first paid month. If on the day before your first charge your tracking is not live, we email you, so you can cancel before the charge if you wish.
Renewal. After the trial, the subscription renews each month at the rate shown when you subscribed, charged to the payment method on file, until you cancel. A subscription month begins on your billing date and ends the day before your next billing date.
Founding rate. If you subscribed at a founding rate, that rate stays for as long as your subscription remains continuously active without a lapse in billing. If you cancel and later subscribe again, the price current at that time applies.
How to cancel. Email [email protected] from the email address on your account, or reply CANCEL to any of our order messages. We confirm your cancellation within one business day. Cancellation takes effect at once, with no further charges. A cancellation received before a billing date stops that charge.
After cancellation. Cancellation does not refund the current month. Identification and deliveries continue to the end of the month you have already paid for, then stop. If you cancel during a free trial, they stop when you cancel, because nothing has been paid. Everything already delivered stays yours under section 10.
Failed payment. If a payment fails, we email you and retry it for 14 days. Identification and deliveries may pause until it succeeds. A charge that succeeds within those 14 days is not a lapse in billing. If it has not succeeded after 14 days, the subscription ends, and the founding rate and any Territory Exclusivity that depends on it end with it.
Prices. Prices are in US dollars. The price shown on the order page when you order is the full price for that order. Any setup fee, if one applies, is shown on the order page before you order.
Payment. One time purchases are charged when you place the order. Subscriptions are charged as section 8 describes. Monthly activation services are charged as section 16 describes. Payments are processed by our payment processor. Your card statement may show that processor's descriptor, and your receipt email states the exact descriptor and your order number.
Refunds, in one place.
Billing disputes. If you believe a charge is wrong, contact us at [email protected] within 60 days of the charge and we will review it with you.
Every record we deliver to you stays yours to use for your own business permanently, including after you cancel or after these Terms end for any reason. That right is subject only to the use rules in sections 11 through 14 and to removal requests from individuals.
When a person exercises a privacy right over their information, we may require you to remove that person's record. We will tell you which record. Section 14 says what you must then do.
You may use the data for your own business, for marketing and sales outreach only. Within that, you may:
The people in your deliveries opted in online to receive information from businesses, on partner sites that disclose it at the point of opt in. They did not fill in a form on your website and they are not expecting to hear from you. Treat them as cold. People identified from your website traffic did not opt in on your website at all.
You may not, in whole or in part:
Some results shown on our pages were produced by other operators who resold lists under their own separate licenses. Your license does not include resale. If you want to resell data, ask us before you buy; that is a different agreement.
If we learn that you are using a delivery in a way this section does not allow, we may require you to stop and to delete the records concerned, and we may suspend or end your services (section 24).
The laws that apply to you. You are responsible for complying with every law that applies to your outreach, including the CAN-SPAM Act, the Telephone Consumer Protection Act, the Telemarketing Sales Rule, the Florida Telephone Solicitation Act, and every other federal and state law on consent, do not call and marketing. The Florida Telephone Solicitation Act applies to any marketing call or text to a Florida number.
Text messages and automated calls. The records in a delivery carry no consent to receive text messages. Nothing we deliver is consent under the Telephone Consumer Protection Act or any state law. You may not send marketing text messages to any number in a delivery unless you have first obtained that person's own prior express written consent in a form the law recognizes. This is because these records carry no texting consent, most texting platforms count as automatic telephone dialing systems, and cold marketing texts are unlawful in several states. Marketing calls to mobile numbers made with an automatic telephone dialing system or a prerecorded or artificial voice need the same consent. You are responsible for knowing which state laws apply to the numbers on your list.
Do not call flags. A do not call flag marks a number that appeared on the federal or a state do not call registry at the time your list was built. It is a screening aid. It is not a scrub of the National Do Not Call Registry on your behalf and you may not rely on it as one. You may not call any number flagged do not call for marketing without that person's consent. Before you call any number, you must hold your own access to the National Do Not Call Registry for the area codes you call, scrub your list against it and against any state registry at the intervals the law requires, and keep your own internal do not call list.
Email validation markers. An email validation marker records the result of a deliverability check on that address at the time your list was built. It is not a promise that a message will be delivered or that the address may lawfully be emailed. Run any list through your own email verifier before a large send.
Neither flag is a guarantee that a number may be called or that an email may be delivered. You remain responsible for your own compliance and your own verification before you make contact.
Stop requests. Honor every request to stop, promptly and permanently, on every channel. Keep your own record of everyone who asks you to stop and apply it to every later delivery, because later deliveries are built fresh. Send every stop request you receive to [email protected] within 5 business days so we can suppress that person from your future deliveries.
Removal notices from us. Some of the people in your deliveries live in California and in other states whose laws treat our delivery to you as a sale of their personal information. When a person asks us to delete their information, to stop its sale, or to be removed from deliveries, we will tell you which record. Your right to that record ends when we tell you. You will then, without delay, delete it from every system and audience you loaded it into, stop contacting that person, and confirm to us in writing that you have done so, all within 10 business days of our notice. You may keep the name and contact details on an internal suppression list for the sole purpose of making sure that person is not contacted again.
Privacy obligations. Because the data includes personal information, you also agree to:
Where a service includes Quantum Identity Resolution, you install the tracking on your website or authorize us to install it for you. The tracking records visits, the pages viewed, the IP address, device and browser identifiers, and a hashed identifier where one is available. We match those against our data sources to put a name and contact details to visitors who did not fill in a form or identify themselves on your website. Visitors are not asked to opt in on your website.
When you install the tracking, or ask us to, you confirm and agree that:
Removing, blocking or altering the tracking during a service stops identification for that period and affects the 40% Guarantee (section 7). We may disable the tracking on any website where we believe its use creates legal risk for you or for us, and we will tell you if we do. When services end, we stop resolving visitors to your website. Anything the code records after that is not delivered and is not kept.
Activation services are done for you work that uses the records we have already delivered. Ordering one does not change the terms of the data you already bought. Each is described and priced on the order page or, for a service sold on application, in the written proposal you accept, and that description forms part of your order.
Monthly activation services are billed monthly to the payment method on file and are cancelled the same way as a subscription under section 8. The current month is not refunded.
Where we send email, run campaigns or manage advertising for you under an activation service:
If you buy Territory Exclusivity, then for the one business category and the one service area named in your order, and confirmed by us in writing when we activate it, we will not build or sell an in market audience in that category and area to another business for as long as your exclusivity is active.
Before we activate your exclusivity we check whether another client already holds an active subscription or an active exclusivity term in that category and area. If one does, we tell you before we activate and refund the exclusivity fee in full. Your exclusivity is active for as long as you hold an active Quantum subscription or an active exclusivity term. The exclusivity term is 12 months from purchase. At the end of the term you may renew it for the same fee.
Territory Exclusivity covers what Quantum itself sells. The underlying records come from sources that other companies also use, so we cannot prevent another supplier from selling records that include the same people. Territory Exclusivity does not restrict any other company, and it does not change what you receive in your own deliveries.
You agree to give us accurate information, including a truthful description of your business and of how you intend to use each delivery. You confirm that your stated use is your real use and that it complies with sections 11 through 13.
You agree to keep your account details confidential. You are responsible for everyone who uses your account or your deliveries.
You agree to keep a working email address on your account. We send deliveries, notices and confirmations to that address.
Access to your systems. Some services need access to your website, hosting, CRM, email sender, advertising account or social account. You give us the access the service needs and confirm that you are allowed to give it. You may withdraw it at any time, and some services stop working when you do. We use that access only to deliver the service, we do not copy your existing contacts for our own use, and we remove the access when the service ends. We keep confidential anything we learn about your business through that access, and you keep confidential anything about our methods and systems that is not public.
We own our methods, tools, software, tracking code, data console, reports and templates, including The Outreach Playbook. You receive a limited, non transferable right to use them, and to use the data and deliveries for your own business as described in these Terms. You may not copy, reverse engineer or resell any part of our services. Section 10 says what you keep, and section 14 says when your right to a single record ends.
One exception. Under Built and Handed Over, the sending domains, inboxes, DNS records and the first sequence become yours outright at handover, as section 16 says. The ownership statements above do not apply to them.
You keep ownership of everything you provide to us, including your build form answers, your brand and your website. You give us permission to use it to deliver your services.
We compile data from third party data providers, publicly available and public record sources, and online data networks. We may change, add or replace those sources and our methods at any time without notice, provided the service you bought continues to be delivered as described in these Terms.
If we cannot deliver a subscription service for a billing period, we do not charge you for that period, or we refund it if it has already been charged, and either of us may cancel the subscription. If we cannot deliver an order at all, we refund it. That is your only remedy for a source interruption.
Our services are provided as described in these Terms. Except for the 40% Guarantee, the market check and the delivery promise, we make no other warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non infringement.
Accuracy. Data is compiled from third party sources. We work to keep it accurate, but we do not warrant that every record is complete, current or correct.
Consent. Records we deliver do not carry consent for any particular contact channel. The consent described in these Terms is the consent the people in your deliveries gave online to receive information from businesses. It is not consent to receive calls or text messages from you, and it is not prior express written consent under the Telephone Consumer Protection Act, the Florida Telephone Solicitation Act or any other telemarketing law. People identified from your website traffic gave no consent on your website at all. We make no warranty that any particular call, text, email or mailing you send is lawful. Whether a channel is lawful for a given record is for you to determine before you use it, as section 13 says.
Flags and markers. Do not call flags, email validation markers and verification results describe the status of a record on the day we built your list. They are screening aids. They do not replace the checks the law requires you to run before you make contact. We do not warrant that a record without a do not call flag may lawfully be called, or that a validated email address will be delivered.
Not a consumer report. The data we deliver is not a consumer report and we are not a consumer reporting agency under the Fair Credit Reporting Act. We make no representation that the data is suitable for any purpose covered by that Act.
Results. Estimates, calculators, examples and results shown on our pages are illustrations. Your results depend on your industry, your traffic, your offer and how you work the list. They are not guaranteed.
To the fullest extent permitted by law, Quantum will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business or data, arising from or related to our services or these Terms, even if we were advised of the possibility.
Our total liability to you for all claims together, whatever their legal basis, will not exceed the amounts you paid us in the 12 months before the first of those claims arose or, if greater, the price you paid for the one time purchase the claims relate to. This is one cap for all claims, not a cap per claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law.
By you. You agree to defend, indemnify and hold harmless Quantum and its members, managers, employees and contractors from any claim, loss or expense, including reasonable legal fees, arising from: (a) your use of the data or deliveries; (b) any outreach or advertising we run for you using the data, your offer, your list and your instructions, including the content, offers and claims in that outreach and the consent status of the people contacted; (c) the installation or operation of the tracking on your website, including any notice your website is required to give its visitors and any consent it is required to obtain from them; or (d) your breach of these Terms. Item (b) does not cover a loss caused solely by our failure to follow your written instructions.
By us. We agree to defend, indemnify and hold you harmless from any third party claim that our technology itself, as we provide it to you and used in line with these Terms, infringes that third party's intellectual property rights. This does not cover claims arising from the data, from your outreach, or from your combination of our technology with anything we did not provide.
How indemnities work. The party seeking indemnity will notify the other promptly of the claim, let the other control the defense and any settlement, and give reasonable help. A settlement that requires the indemnified party to admit fault or pay money needs its written consent.
You may stop using our services at any time. Subscriptions and monthly activation services are cancelled as section 8 describes.
We may suspend or terminate your services, in whole or in part, if you breach these Terms, misuse data, fail to pay, or use the data or the tracking in a way we reasonably believe is unlawful or creates legal risk. Where practical we will tell you first and give you a chance to fix it. A suspension or termination for these reasons does not refund anything already paid, except where the law requires a refund. We may also decline to deliver under the market check in section 6, or end a service under section 20, and those sections say what you receive when we do.
When your services end, for any reason:
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules.
Talk to us first. Most problems are solved by an email. Write to [email protected] and a person answers. Before starting arbitration or a court claim, the party raising the dispute will send the other a written description of it and give the other a fair chance to resolve it. Send yours to [email protected]. We send ours to the email address on your order.
Arbitration. Any dispute arising from these Terms or our services that we cannot resolve between us will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Miami-Dade County, Florida. Arbitration fees are allocated as those rules provide. The arbitrator may award the same individual relief a court could award to that party. Judgment on the award may be entered in any court with jurisdiction.
Small claims. Either party may instead bring an individual claim in small claims court in Miami-Dade County, Florida, if the claim qualifies for that court.
Injunctions. Either party may ask a court with jurisdiction for an injunction to protect its intellectual property or confidential information, or to enforce sections 11 through 15 or section 17.
Opt out. You may opt out of arbitration by emailing [email protected] within 30 days after your first order, stating your name, your business name and the email address on your order, and that you opt out of arbitration. If you opt out, disputes go to the courts named below. Opting out does not affect anything else in these Terms.
Class action and jury waiver. You and Quantum each agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective or representative proceeding, and each waive any right to a jury trial to the extent the law allows. If the class action waiver is found unenforceable for a particular dispute, the entire agreement to arbitrate is void for that dispute, and that dispute will be heard in the courts named below. The class action waiver is not severable from the agreement to arbitrate.
Courts. Any dispute that is not arbitrated, other than a small claims case, will be brought only in the state or federal courts located in Miami-Dade County, Florida, and you and Quantum each consent to the jurisdiction of those courts.
We may update these Terms. The current version, with its date at the top, is always posted at the Terms of Service link on our websites.
A material change takes effect 30 days after we post it and email it to every active client. An active client is a client with an active subscription, an active trial, an active monthly activation service, an open order or an active exclusivity term. A change applies to orders placed after its effective date. For a subscription or monthly activation service you already hold, it applies from the first renewal after the notice period ends. If you do not accept a change, cancel before that renewal.
Some changes never reach an order you already placed. A change to a price, including a founding rate you hold, to the 40% Guarantee, to the market check, to the delivery promise, to the refund terms, or to the use rules in sections 11 through 14, does not apply to an order already placed, including a subscription you already hold. No change applies to a dispute either of us raised before the effective date.
We send notices to the email address on your account. Send notices to us at [email protected] or to the postal address in section 29. A notice by email counts as written notice under these Terms.
If you ticked the first box at checkout, we send you text messages about your order, your build form and your delivery. If you ticked the second box, we also send marketing text messages. Both boxes are optional and consent is not a condition of purchase. Messages may be sent using automated technology. Message frequency varies and message and data rates may apply. Reply STOP to opt out and HELP for assistance.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Entire agreement and precedence. These Terms, our Privacy Policy, your order and any written proposal you accept for a service sold on application are the entire agreement between us for each service. These Terms govern. The order page supplies the product, the price and the delivery timing for your order. If the order page and these Terms conflict on anything else, including the start of a trial or the date of a first charge, these Terms control. Other statements on our pages describe the services and how buyers use them and are not contract terms.
Severability. If any part of these Terms is found unenforceable, the rest stays in effect, with one exception. If the class action waiver in section 25 is found unenforceable for a particular dispute, the agreement to arbitrate does not apply to that dispute, as section 25 says.
Assignment. You may not assign these Terms or any order without our written consent. We may assign them to a successor to our business, and we will tell you if we do.
No waiver. If either of us does not enforce a term at some point, that does not waive the right to enforce it later.
Relationship. We are independent contractors. Nothing in these Terms creates a partnership, joint venture, agency or employment relationship.
Survival. Sections 10 through 15, 19, 21 through 23, 25 and 28 survive the end of these Terms, together with any remedy you earned under section 7 before the end, any payment you still owe under section 9, and any obligation in section 16 or section 17 that relates to a period before the end.
